Medical Board of California disciplines license
of Yuba City/Marysville physician
SACRAMENTO — The medical license of Ifeanyi Igwegbe, M.D. has been disciplined by the Medical Board of California. "The mission of the Medical Board is public protection, and this action reflects the Board's ongoing commitment to that mission," said Linda Whitney, executive director of the Medical Board.
On May 25, 2010, Igwegbe was arrested and charged with two felonies: driving under the influence and causing bodily injury, a violation of Vehicle Code section 23153(a), and driving with a blood alcohol content of .08 or more, a violation of Vehicle Code section 23153(b). Witnesses observed Igwegbe's vehicle weaving and traveling at speeds up to 80 miles per hour, when the vehicle began to spin, sliding through the center median and hitting a car traveling in the opposite direction, injuring that driver. Igwegbe told the arresting officer he was a physician and on his way to work. He stated he had patients waiting for him and procedures scheduled. The arresting officer administered a series of field sobriety tests, which Igwegbe failed. Igwegbe was taken to Rideout Memorial Hospital where he provided a blood sample. On June 7, 2010, the blood sample was found to be positive for alcohol at a level of 0.13 percent.
On July 16, 2010, an Interim Suspension Order was issued, immediately suspending Igwegbe's license to practice medicine. A full hearing was held on July 21, 2010. Igwegbe maintained his innocence and pointed out he has cooperated with three psychological evaluations, and voluntarily reported his arrest and pending criminal action to the Medical Board. He stated he has been cooperative, and his employer has safeguards in place, which include requiring him to submit to a daily breathalyzer test and random urine tests. After consideration, the court determined the procedures and protocols in place would ensure patient safety and the Interim Suspension Order was upheld, but with limited restrictions, stating Igwegbe should not be on call at any time, and he could not practice at any facility other than his current employer, Sutter Medical Foundation North, the Endoscopy Center, and Fremont-Rideout Hospital. Each location has policies and protocols in place to ensure Igwegbe is not intoxicated or otherwise impaired to practice medicine, and Igwegbe stated he was willing to abide by any additional practice or license restrictions imposed in this case.
Igwegbe filed a motion to seek modification of the Interim Suspension Order, which was heard on July 29, 2010. Igwegbe stated he was dissatisfied with his current employer because of their treatment of him in this matter. He stated he wanted to resign from his current position and seek employment at Oroville Hospital. He stated Oroville Hospital was aware of his pending criminal matter, had presented a job offer to him, and would implement the same safety procedures in place at his current employment; however, Igwegbe presented no documentation to the court from Oroville Hospital to support his claim. Subsequently, the judge ordered the Interim Suspension Order remain in effect, and the Medical Board adopted this order.
The 48 year old doctor reportedly told officers he was on his way to perform several surgeries at Rideout Hospital at the time of the crash. Igwegbe was not injured in the crash and was booked into Sutter County Jail on DUI charges. The woman in the other car suffered minor injuries but was not taken to the hospital.
According to Vitals.com, Dr. Dr. Ifeanyi Igwegbe is a board-certified gastroenterologist with 12 years of experience.
Ifeanyi Charles Igwegbe is scheduled to be arraigned next month on two felony counts of causing injury by dui.
His attorney says he intends to plead not guilty and says his client had not been drinking that morning.
Igwegbe -- a gastroenterologist -- was scheduled to perform five procedures on May 25, on the day of the crash.
According to court documents, other drivers noticed Igwegbe's 2006 Honda Accord weaving at about 80 mph before his vehicle crossed the center line and hit a car causing injuries to its driver that a lawsuit says will result in "some permanent disability."
The California Highway Patrol says Igwegbe refused to take a breath test after the accident. A blood test found that his blood alcohol level was 0.13, 0.5 point over the legal limit.

A former Yuba City doctor, convicted in July of driving under the influence when he crashed into an Olivehurst woman's car, can no longer practice medicine, the Medical Board of California ruled Friday.
The board formally revoked the license of Ifeanyi Charles Igwegbe, according to Linda Whitney, executive director of the state board.
"The mission of the Medical Board is public protection, and this action reflects the Board's ongoing commitment to that mission," Whitney said in a statement.
Igwegbe, 49, of North Highlands, was convicted by a Sutter County Superior Court jury of injuring Lilia L. Munoz while driving drunk on May 25, 2010, on Highway 99/70 in south Sutter County.
Igwegbe performed colonoscopies at Rideout Memorial Hospital and was on his way to work when lost control of his Honda Accord north of Riego Road, crossed the median and crashed into Munoz's car, authorities said.
His blood-alcohol content was 0.13 percent, nearly twice the legal limit, about 90 minutes after the crash, according to court records.
"He would have been intoxicated at the time of any medical procedure performed at 9 a.m. that same morning," Whitney said.
Igwegbe has consistently denied being intoxicated at the time.
Witnesses reportedly saw Igwegbe's vehicle swerve at least four times moments before the crash. At his trial in July, Igwegbe testified he was reaching for his cellular phone at the time.
Igwegbe is due for sentencing Nov. 18, but court documents indicate he is considering filing a motion for a new trial. Records show he has fired his trial attorney, Michael J. Khouri, and replaced him with John P. Brennan of Sacramento.
Brennan wrote that Igwegbe's trial lawyer may have failed to provide adequate legal representation. Lawyers at the office said they had no comment.
Igwegbe faces a maximum sentence of three years in prison, but prosecutors have previously said it is more likely he will receive probation since he has no prior criminal record.
Other legal troubles are mounting against the former physician.
Munoz filed a personal injury lawsuit against Igwegbe in August last year seeking unspecified damages. That case is due back in court Dec. 5.
At a July hearing of the state Medical Board, lawyers for Igwegbe argued he had already been "punished enough" and had been unable to find a job in nearly two years.
"The Medical Board argued that Igwegbe's behavior on May 25, 2010, showed he posed a serious risk to the public and his patients," Whitney said.
Igwegbe received his medical degree from American University of the Caribbean School of Medicine in 1994. He completed his residency training and fellowship at the University of Medicine and Dentistry of New Jersey, according to the Sutter North Medical Group website.
He remains free on bail pending sentencing.
