The petition brought to the election petition tribunal sitting in Makurdi by the candidate of All Progressives Congress (APC), Daniel Onjeh seeking to be declared the winner of the election has been struck out by the tribunal.

It was learnt that Onjeh requested the tribunal to declare him the winner of the election that was won by Mark.
Justice Chinyere Gloria Anulube during her ruling held declared the petition “defective and incurably bad,” because it came after the 21days entrenched in the Nigerian Constitution.

According to the judge, “We hold that all pending applications before the court having been overtaken by event is thereby struck out.”
Mark contested for the Benue South Senatorial District under the umbrella of the PDP while Onjeh contested under the APC.
